Regular Session August 13, 2026
The Pinal County Board of Supervisors convened at 9:38 a.m. this date in the Board of Supervisors Hearing Room, Administration Building No. 1, Florence, Arizona. The meeting was called to order followed by the Pledge of Allegiance and Roll Call. Present: Chairman Sandie Smith; Supervisor Jimmie B. Kerr; Supervisor Lionel D. Ruiz; County Manager/Clerk of the Board, Stanley D. Griffis, Ph.D.; Chief Civil Deputy County Attorney, William McLean; Deputy County Attorney, Patricia Grieb; Deputy Clerk of the Board, Sheri Cluff. Discussion/approval/disapproval of the Fiscal Year 2003-2004 Property Tax Levies and Rates for certain Governmental Entities of Pinal County. Motion was made by Supervisor Ruiz and seconded by Supervisor Kerr to approve the Fiscal Year 2003-2004 Property Tax Levies and Rates for all Governmental Entities of Pinal County. The Property Tax Levies and Rates are subject to any legal changes mandated by the revision of valuations, errors, omissions, and exclusions beyond current knowledge and/or control. Application for Fireworks Display on September 1, 2003, at Saddlebrook Golf Course, 64500 E. Saddlebrook Blvd., Tucson, AZ; S. Resolution No. 81303-SMC to designate the community of San Manuel as a Colonia; * T. Resolution No. 81303-RED authorizing Pinal County to enter into an agreement releasing certain real property from the Development Agreement and amending the Development Agreement dated August 30, 2000, for the development of Rancho El Dorado. Motion carried by unanimous vote. Public Hearing and discussion/approval/disapproval of Resolution No. 81303-PBR on the vacation of a portion of right-of-way within Papago Butte Ranchos Unit 3 and Unit 4, as recorded in Book 18, Page 45 and Book 18 Page 48 of the Pinal County Records, located within Section 18, Township 5 South, Range 3 East, within the unincorporated area of Pinal County, Arizona. Motion was made by Supervisor Kerr and seconded by Supervisor Ruiz to approve Resolution No. 81303-PBR on the vacation of a portion of right-of-way within Papago Butte Ranchos Unit 3 and Unit 4, as recorded in Book 18, Page 45 and Book 18 Page 48 of the Pinal County Records, located within Section 18, Township 5 South, Range 3 East, within the unincorporated area of Pinal County, Arizona. Public Hearing, pursuant to A.R.S. 49-112 and 49-479, to be followed by the Board's discussion/approval/disapproval of the amendments to the Pinal County Air Quality District Code of Regulations: Rules 1-1-107, 3-2-220 and 3-2-230. The range of possible actions has been described in a notice published in the Arizona Administrative Register, June 20, 2003. The Board may choose to adopt the resolution, approving all, part or none of the proposed resolution or other actions. Motion was made by Supervisor Ruiz and seconded by Supervisor Kerr to approve Resolution No. 081303-AQ1 - (New Source Review Changes - Rules 1-1-107, 3-2-220 and 3-2-230. Motion carried by unanimous vote. Public Hearing, pursuant to A.R.S. 49-112 and 49-479, to be followed by the Board's discussion/approval/disapproval of the amendments to the Pinal County Air Quality District Code of Regulations: Rules 1-107, 3-1-030 through 3-1-083, 3-2-180 through 3-2-195, 3-4-420, 3-7-578 through 3-7-650, and Appendix A and B. The range of possible actions has been described in a notice published in the Arizona Administrative Register, June 20, 2003. The Board may choose to adopt the resolution, approving all, part or none of the proposed resolution or other actions. Motion was made by Supervisor Kerr and seconded by Supervisor Ruiz to approve Resolution No. 081303-AQ2 - (Permit Fee Changes - Rules 1-1-107, 3-1-030 through 3-1-083, 3-2-180 through 3-2-195, 3-4-420, 3-7-578 through 3-7-650, and Appendix A and B. Motion carried by unanimous vote. Public Hearing to consider the petition from Gold Canyon Sewer Company for an expansion of its sewer franchise to Entrada Del Oro Subdivision located near El Camino Viejo Rd and US 60. Legal description is as follows: Government Lots 1, 2, 3, the SE1/4 of the SW1/4, the SE1/4 of the NW1/4, the NE1/4 of the SW1/4, S1/2 of the NE1/4, the NE1/4 of the NW1/4 and the N1/2 of the NE1/4 of Section 30, Township 1 South, Range 10 East, Gila & Salt River Base and Meridian, Pinal County, Arizona. Motion was made by Chairman Smith to deny the petition from Gold Canyon Sewer Company for an expansion of its sewer franchise to Entrada Del Oro Subdivision. Chairman Smith called for a second. There was no second. Motion was made by Supervisor Kerr to table this item for further clarification and review. County Manager, Stanley Griffis, requested a five minute recess with the County Attorney. The Board recessed at 10:33 a.m. The Board reconvened at 10:36 a.m. Discussion/action on the petition from Gold Canyon Sewer Company for an expansion of its sewer franchise to Entrada Del Oro Subdivision continued. Supervisor Kerr withdrew his motion. Motion was made by Chairman Smith and seconded by Supervisor Kerr to deny the petition from Gold Canyon Sewer Company for an expansion of its sewer franchise to Entrada Del Oro Subdivision. Motion carried by unanimous vote. Discussion/approval/disapproval of the following bid(s): Richard Lampert: Parcel No. 403-25-05101, Toltec Arizona Valley Unit 32, Lot 8, Block D, in the amount of $500.00; Parcel No. 403-25-05200, Toltec Arizona Valley Unit 32, Lot 9, Block D, in the amount of $500.00; Parcel No. 403-25-05309, Toltec Arizona Valley Unit 32, Lot 10, Block D, in the amount of $500.00. Motion was made by Supervisor Ruiz and seconded by Supervisor Kerr to accept the bids as presented and it was further moved by Supervisor Ruiz and seconded by Supervisor Kerr that the Chairman and the Clerk be authorized to execute all documents necessary to complete the transaction. Motion carried by unanimous vote. Work Session with the Board of Supervisors to review the proposed Pinal County Judicial Enhancement Fee Ordinance and a Resolution to support and establish a Judicial Enhancement Fund Fee Schedule. Paul O'Connell, Court Administrator, Pinal County Superior Court, appeared before the Board to review the proposed ordinance and fees. Mr. Griffis advised Mr. O'Connell that after the work session they should follow the procedures outlined in Resolution No. 31302-OP. Executive Session: 10:45 a.m. - Motion was made by Supervisor Ruiz and seconded by Supervisor Kerr to recess for Executive Session with the Pinal County Attorney in accordance with the provisions A.R.S. 38-431.03 (A)(3) for the purpose of consultation for legal advice with the attorneys of the public body for the purpose of discussing the possible termination of the lease with Evergreen Air Center at the Pinal Air Park and the possibility of employing outside counsel in connection therewith. Motion carried by unanimous vote. The Board moved into the office of the County Manager for the executive session. Present: Chairman Sandie Smith; Supervisor Jimmie B. Kerr; Supervisor Lionel D. Ruiz; Deputy County Manager, Terry Doolittle; County Manager/Clerk of the Board, Stanley D. Griffis, Ph.D.; Chief Civil Deputy County Attorney, William McLean; Deputy County Attorney, Patricia Grieb; Airport Manager, Jim Petty; Deputy Clerk of the Board, Sheri Cluff. Those attending the executive session, except for Mr. McLean who left during the executive session, moved back to the Board of Supervisors hearing room. 11:07 a.m. - Motion was made by Supervisor Kerr and seconded by Supervisor Ruiz to adjourn from executive session and reconvene into regular session of the Board of Supervisors. Motion carried by unanimous vote. Discussion/approval/disapproval of a request by staff to employ outside counsel for the purpose of beginning legal proceedings to terminate the lease between Pinal County and Evergreen Air Center at Pinal Air Park. Motion was made by Supervisor Ruiz and seconded by Supervisor Kerr to approve the request by staff to employ outside counsel for the purpose of beginning legal proceedings to terminate the lease between Pinal County and Evergreen Air Center at Pinal Air Park. Executive Session: 11:14 a.m. - Motion was made by Supervisor Ruiz and seconded by Supervisor Kerr to recess for Executive Session for discussion and consultation for legal advice with attorneys for the County relating to possible authorization for litigation concerning Daniel E. and Pamela Jean O'Malley, in accordance with the provision of A.R.S. 38-431.03(A)(3). The Board moved into the office of the County Manager for the executive session. Present: Chairman Sandie Smith; Supervisor Jimmie B. Kerr; Supervisor Lionel D. Ruiz; County Manager/Clerk of the Board, Stanley D. Motion was made by Supervisor Ruiz and seconded by Chairman Smith to remove this item from the agenda. Motion carried by unanimous vote. County Manager's Report 'Information Only'. There was no County Manager's report. Call to Public. There was no one present who wished to address the Board. There being no further business the meeting stood adjourned at 11:27 a.m. The next regular meeting of the Pinal County Board of Supervisors will be on Wednesday, September 3, 2003, 9:30 a.m, with the possibility of a telephonic meeting before then.
